LIABILITY WAIVER, LIMITED WARRANTY, INSTALLATION & USE WARNINGS

This document ("Agreement") applies to all products manufactured, sold, or distributed by The Cold Life LLC ("The Cold Life"), including but not limited to cold plunge tubs, chillers, accessories, and the Ultimate Showerhead (collectively, the "Products").

By purchasing, installing, using, or permitting others to use the Products, you acknowledge that you have read, understood, and agreed to the terms set forth below.

1. LIMITED WARRANTY

Warranty Coverage

The Cold Life provides a Limited Warranty covering defects in materials and workmanship for a period of one (1) year from the date of original retail purchase by the original purchaser.

During the applicable warranty period, The Cold Life will, at its sole discretion, repair or replace any defective part or product returned by the original purchaser and determined to be covered under this Limited Warranty.

What Is Not Covered

This Limited Warranty does not cover damage or failure resulting from:

  • Abuse, accident, misuse, neglect, or improper maintenance
  • Improper installation, electrical supply, plumbing, or water pressure
  • Failure to follow instructions or recommended use
  • Power outages, surges, or inadequate electrical protection
  • Freezing conditions or exposure to extreme weather
  • Poor water chemistry, lack of filtration, or improper sanitation
  • Use of improper or harsh cleaning agents
  • Use of non-genuine or unauthorized replacement parts or accessories
  • Normal wear and tear or cosmetic imperfections

Products for which The Cold Life has not received payment are expressly excluded. Including those that have open balances for repairs not covered under warranty claims.

2. PRODUCT-SPECIFIC WARRANTY CLARIFICATIONS

Cold Plunge Units

  • Cold plunge tubs are handmade in the United States and may contain minor cosmetic blemishes, variations, or imperfections, including scratches, dents, variations in finish, size, or shape
  • These characteristics are inherent to the handmade manufacturing process and are not considered defects
  • Outdoor units may experience natural wear due to environmental exposure

Chillers & Components

  • Water chillers are covered for one (1) year
  • Water filters are consumables and are not covered
  • Replacement of filters is the customer's responsibility
  • The Cold Life is not responsible for lost or damaged plumbing components, such as hoses, fittings, gaskets, or O-rings, unless installation is performed by an authorized technician

Ultimate Showerhead

  • The Ultimate Showerhead is covered for defects in materials and workmanship for one (1) year
  • Damage caused by excessive water pressure, incompatible plumbing, improper installation, or misuse is not covered

Accessories

  • Items purchased separately (including but not limited to filters, covers, Skimmies, or other accessories) are not covered under this Limited Warranty unless expressly stated.

3. WARRANTY VOIDANCE

This Limited Warranty is automatically void if The Cold Life determines the Product has been:

  • Altered, modified, or repaired by an unauthorized party
  • Neglected or improperly maintained
  • Used for purposes other than intended
  • Operated with improper water chemistry or sanitation
  • Installed or operated outside of published specifications

4. WARRANTY DISCLAIMERS & LIMITATIONS

This Limited Warranty provides you with specific legal rights, which may vary by state.

To the fullest extent permitted by law:

  • All other warranties, express or implied, including implied warranties of merchantability or fitness for a particular purpose, are disclaimed
  • The Cold Life shall not be liable for incidental, indirect, or consequential damages
  • The Cold Life's total liability shall not exceed the amount paid for the Product

Some jurisdictions do not allow certain exclusions, so these limitations may not apply to you.

5. HOW TO OBTAIN WARRANTY SERVICE

To request warranty service, contact help@thecoldlife.com and provide:

  • Proof of purchase
  • Product information
  • Description of the issue

If a repair is approved:

  • Parts may be covered, but shipping costs are the customer's responsibility
  • Certain repairs may be performed by the customer
  • If professional service is required, The Cold Life may reimburse up to $25/hour for an approved service provider, at its discretion

All repairs must be approved and authorized by The Cold Life. Unauthorized repairs void the warranty.

6. ASSUMPTION OF RISK & PRODUCT USE NOTICE

Use of the Products involves inherent risks, including but not limited to:

  • Cold shock, hypothermia, fainting
  • Electrical hazards
  • Slips, falls, or drowning risk
  • Water pressure or temperature exposure

You voluntarily assume all risks, known or unknown, associated with installation and use.

The Products are not medical devices and are not intended to diagnose, treat, or cure any condition. Consult a physician prior to use if you have medical conditions, are pregnant, or are sensitive to temperature changes.

7. INSTALLATION WARNINGS & USER RESPONSIBILITY

You are solely responsible for proper installation and compliance with all applicable building, plumbing, and electrical codes.

Electrical Safety (Plunges & Chillers)

  • Use only properly grounded GFCI-protected outlets
  • Never use extension cords or damaged plugs
  • Keep all electrical connections dry and elevated
  • Disconnect power before cleaning or servicing

Plumbing Safety (Plunges & Showerhead)

  • Ensure proper sealing and compatible plumbing
  • Monitor water pressure and temperature
  • Immediately discontinue use if leaks or abnormal conditions occur

8. WATER SANITATION & OZONE WARNINGS

  • You are responsible for maintaining clean and safe water conditions.
  • Filters must be cleaned regularly
  • Water should be changed as recommended

Aftermarket Ozone System Disclaimer

The Cold Life does not manufacture, sell, supply, or recommend ozone generators or ozone-based water sanitation systems.

If a customer chooses to install or use any aftermarket ozone system, such installation and use are done entirely at the customer's own risk. The Cold Life accepts no liability for any damage, injury, or loss arising from the use of aftermarket ozone equipment.

If an ozone system is added, it must not be installed inline with the Pro Curve Chiller or connected to the chiller's internal water path. Inline ozone installation can cause premature degradation of internal components, including seals, tubing, and refrigeration-related components.

Any damage resulting from the installation or use of an aftermarket ozone system, including but not limited to inline installation, is not covered under The Cold Life Limited Warranty and will result in denial of warranty repair or replacement for affected components.

9. COLD EXPOSURE SAFETY WARNINGS

  • Not intended for use by children under 18
  • Not recommended for individuals with heart, circulatory, or neurological conditions without physician approval
  • Do not use while under the influence of drugs or alcohol
  • Limit exposure time; first-time users should start with very short sessions
  • Exit immediately if discomfort, dizziness, or chest pain occurs

10. LIMITATION OF LIABILITY & INDEMNIFICATION

To the fullest extent permitted by law, The Cold Life shall not be liable for damages arising from use or inability to use the Products.

You agree to indemnify and hold harmless The Cold Life and its affiliates from any claims arising from misuse, improper installation, or violation of this Agreement.

11. GOVERNING LAW & DISPUTE RESOLUTION

This Agreement is governed by the laws of the State of Georgia.

Any disputes shall be resolved by binding arbitration administered by the American Arbitration Association, with venue in Atlanta, Georgia, unless otherwise required by law.

12. BINDING AGREEMENT

By using the Products, you acknowledge that you have read, understand, and agree to be bound by this Agreement. If you do not agree, do not install or use the Products.
